PROBLEMS OF DOWRY SYSTEM:

INTRODUCTION:

Dowry system entails giving huge amount of cash, jewellery and other gifts to the groom’s family by the bride’s parents as a condition at the time of marriage. … In many cases, the bride turns to her family to meet the demands of her in-laws while others end up giving their lives to end the torture.Dowry is the activity taken place at the time of marriage when the bride’s family transfers wealth to the groom’s family in the form of cash, movable properties, or immovable properties. The existence of the dowry system is hard to trace, but it has long existed in India.

PROBLEM OF DOWRY SYSTEM:

The dowry system can put great financial burden on the bride’s family. In some cases, the dowry system leads to crime against women, ranging from emotional abuse and injury to even deaths.Dowry is referred to as Dahez in Arabic. In the far eastern parts of India, dowry is called Aaunnpot. The Dowry Prohibition Act 1961 defines dowry: “Dowry means any property or valuable security given or agreed to be given either directly or indirectly – (a) by one party in marriage to the other party in marriage; or (b) by the parents of either party to a marriage or by any other person to either party to marriage or to any other persons;at or before or after the marriage as consideration for the marriage of the said parties, but does not include dower or mahr in the case of persons to whom the Muslim Personal law applies.

“The payment of dowry has long been prohibited under specific Indian laws including the Dowry Prohibition Act 1961 and subsequently by Sections 304B and 498A of the Indian Penal Code.

Disadvantages of Dowry System in India. … Practice of dowry which assumed the form of an institution over the years has caused lots of hardship to large number of people in the Indian society. It reduces the sacred institution of marriage to business transaction.

The word ‘dowry’ means the resources and money which is brought by the bride to her husband’s home at the time of her wedding. This practice has been proved evil for the bride and her parents because many times this practice leads to social violence on the females if they lacks to fulfill the demands of the dowry.

EXAMPLES:

Payment, as property or money, of a bride’s inheritance by her family to the groom or his family at the time of marriage. … An example of a dowry is a flock of sheep and a bag of gold coins that a woman’s parents give to her husband when they are married. An example of a dowry is a toddler being able to play the piano.

The expectation that a dowry will be given at the time of the bride and groom’s engagement is to compensate for the groom’s education, career, and wealth. The bride’s education, career, and wealth are completely disregarded, as she is not given equal societal status to a man.

The Purpose of a Dowry :The dowry is intended to help set up the couple’s new household, especially in cultures where it is rare for a woman to work outside the home. If a woman died without having any sons, her husband would have to return the dowry to the bride’s family, deducting the value of the bride price.
